Appellate

The key to winning an appeal is foresight. An appeal doesn’t begin with the filing of a notice; it begins with the groundwork laid at the trial level. Accordingly, our appellate team provides expertise beginning with the pleadings stage of litigation all the way through a final appeal. This includes temporary or preliminary injunctions, dispositive motions, discovery motions, trial briefing, jury instructions, post-trial briefing, and—ultimately—the appellate briefing and argument.

With intentional strategy and well-crafted briefing, our appellate practitioners are able to secure important victories for clients spanning a wide range of industries. Our expertise includes intellectual property, trade secrets, securities, antitrust, government litigation, tribal law, business torts, commercial contracts, shareholder disputes, trust estates, closely held family disputes, and employment. Members of our appellate group are admitted to practice in Oregon, Washington, California, New York, and D.C., as well as the U.S. Supreme Court and U.S. Court of Appeals for the Ninth, Tenth, and Eleventh Circuits.

Our team is co-chaired by Shareholders Paul Bierly and Anit Jindal. Paul is a seasoned appellate lawyer with more than thirty years of experience in Oregon and Washington courts of appeal and the Ninth Circuit Court of Appeals. He has authored countless briefs and motions that resulted in favorable opinions for clients. Paul has consistently provided clients with a deep well of knowledge for all stages of litigation.

Anit likewise has more than a decade of experience with appeals and motion practice in Oregon and the Ninth Circuit. He has secured repeated victories for clients across a range of issues, including statutory interpretation, forum selection, and transfer. His appellate insight is fueled by his experience clerking for Judge Morgan Christen of the Ninth Circuit and Justice Maassen of the Alaska Supreme Court.

The appellate team is also joined by associate Joseph Levy, who has spent years litigating appellate cases in state and federal courts, including multiple Supreme Court petitions. Following his clerkship with Judge David Ebel of the Tenth Circuit, Joseph established the blog “Part of the Appeal,” where he provides updates on important appellate cases in Oregon, California, and the Ninth Circuit.

Our appellate team also includes shareholders Stanton Gallegos, Lauren Blaesing, Dallas DeLuca, and associate Erin Dawson. These attorneys bring a breadth of knowledge acquired during their time clerking on the Oregon Supreme Court, Oregon Court of Appeals, U.S. Court of Appeals for the Second Circuit. Together, they’ve crafted countless motions and briefs across a range of states and federal courts.
