Bamboo Sushi founder raises the stakes in legal fight against investor Bain Capital
May 04, 2020
Trial lawyer Chad Colton is quoted in a recent Portland Business Journal article about his client's case against Massachusetts based private investment firm, Bain Capital.
Kristofer Lofgren, Founder and CEO of iconic restaurant Bamboo Sushi, is seeking a payout for Bamboo's holding company, Sustainable Restaurant Holdings (SRH), in a derivative action. The legal strategy allows Lofgren, a shareholder, to demand money on SRH's behalf from Bain and fund manager Christopher Cozzone for what he claims was their breach of fiduciary duty to SRH.
"Kristofor did not make the decision to file a lawsuit lightly, and before proceeding any further on his claims, Kristofor felt a duty to Bamboo Sushi’s employees and friends to try to reach a resolution with Bain Capital. Unfortunately, those efforts fell flat," said Chad Colton, an attorney with Portland law firm Markowitz Herbold.
"Having now made those efforts, Kristofor is intent on taking this case to trial before a Portland jury," Colton said in an email. "My firm and I are excited to partner with him to tell the Bamboo Sushi story at trial."
